An Australian partner visa allows the spouse or de facto partner of an Australian citizen, permanent
resident, or eligible New Zealand citizen to live and work in Australia. It’s designed to facilitate family
reunification by enabling partners to join their loved ones in Australia.
There are different subclasses of partner visas, the main ones are:
- subclass 820 Partner Visa (onshore)
- Subclass 309 Partner Visa (offshore)
- Subclass 300 Prospective (Fiancé) Marriage Visa (offshore)
An Australian partner visa lets you live with your partner in Australia. It’s sometimes called a de-facto, marriage, or fiancé visa. The Australian partner visa is open to all couples including same sex couples.
After two years from the date of application of a partner visa (820 or 309) you become eligible to submit the Permanent Partner visa which ultimately leads to Permanent Residence (PR).
After the grant of Permanent Residence, the visa holder has the right to stay indefinitely in Australia.
If after 5 years from the date of grant of Permanent Residence (PR) the visa holder wishes to travel in and out of Australia, they either need to obtain a Resident Return Visa or Australian Citizenship.
You and your partner need to prove that you are in a genuine relationship.
In determining if you and your partner are in a ‘Genuine Relationship’, a Case Officer will consider the totality of your relationship and the following four factors:
- Financial aspects of your relationship
- Nature of your household
- Social aspects of your relationship
- Nature of you and your partners commitment to each other
Our DIY Partner Visa Package provides an easy-to-follow list of all the documents you and your partner are required to provide such as;
- Identity documents
- Previous relationship documents
- Genuine relationship proof documents
Our DIY Partner Visa Package outlines in detail the documents you will need to prove your genuine relationship to your Case Officer.
In addition, we provide a ‘Document Types Booklet’ that lets you see what over a hundred different documents look like and suggests alternatives to provide where you are unable to provide the requested document.
You may also use it as a guide to replace certain documents that you don’t have or could replace another document in its place with, such as alternative proof of identity or as alternative proof of your genuine relationship.
